What Types of Information We Collect

We collect information that identifies, relates to, is reasonably capable of being associated with a particular living person either by itself or in connection with other information ("Personal Data"). In this Privacy Policy, we use the term Personal Data to mean the same thing as these other terms. If a specific type of personal data has its own definition, we will provide that definition and use that name specifically.

We do not collect Sensitive Personal Data, which includes Social Security Number, driver's license, state identification card, or passport number, racial or ethnic origin, union membership, information related to a consumer's citizenship or immigration status.

If you do not provide personal data

Where we need to collect personal data by law or pursuant to a contract with you and you do not provide the requested data, we may not be able to perform the contract we have trying to enter into or have entered into or with you. If that is the case, we will inform you at that time and we reserve the right to cancel a service you have contracted with us.

Usage Data

We may automatically collect certain information through the use of cookies or other similar tracking technologies when you access our Site and use our Services. Usage Data does not reveal your specific identity (like your name or contact information) but may include device, internet traffic and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you access the Site and use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Site and Services, and for our internal analytics and reporting purposes.

The analytics tools provide use with aggregated data about the Site's traffic and interactions, enabling us to improve the user experience on our Site.

Where the legal basis for processing your Personal Information is our legitimate interests, those interests are to use Personal Information to conduct and develop our business activities with users and with others in order to support our reputation and increase our revenues, while limiting the use of Personal Information to those purposes that strictly support the conduct and development of our business within the reasonable expectation of the individuals concerned.

Limitation or Change of Purpose

We will use your Personal Data for the purposes for which we collected it or another purpose that is compatible with the original purpose after we disclose that to you. An incompatible purpose is one that is very different from the original purpose, that which would be unexpected by you, or one that would have an unjust impact on you. When we disclose Personal Data for a business purpose, such as when our service providers need to process your Personal Data, we enter into a contract with the third party recipient that describes the purpose and requires them to both keep that Personal Data confidential and not use it for any purpose except performing the services under the contract.

Where We Store Your Personal Data

We are based in the United States. The information that we collect from you (including Personal Data) may be transferred to, and stored at, a destination outside of the country in which you initial provided or we collected it. It may also be processed by our service providers who may operate outside your country, for one of our suppliers or one of our business partners. By submitting your information, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your information is treated securely and in accordance with this Policy and applicable law.

How Long Do We Retain Your Personal Data

We keep your Personal Data for as long as reasonably necessary to fulfil the purposes for which we collected it. For example, we may retain your Personal Data as long as your user account remains open. For certain types of information, we may need to retain it for a longer period of time to meet applicable legal, regulatory, tax, accounting or reporting requirements. We may also retain your Personal Data for a longer period in the event of a complaint or if we reasonably believe that there is a prospect of litigation concerning our relationship.

In the event we reasonably believe that we may need your Personal Data to enforce or defend our legal rights, we may retain your Personal Data for a longer period of time.

Keeping Your Information Safe

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security and integrity of any Personal Data we process. In addition, we limit access to your Personal Data to those who have a business need to know. They will only process your Personal Data on our instructions and are subject to confidentiality obligations. However, despite our safeguards and efforts to secure your information, no information transmission over the Internet or electronic storage technology can be guaranteed to be completely secure, so we cannot guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly access, steal, or modify your information.

You also play an important role in keeping your information safe. Use a strong password. Do not share your log in credentials with someone else. Public Wi-Fi is notoriously insecure, so you should only access the Site and use the Services within a secure environment.

Although we will do our best to protect your personal information, Transmission of information, including Personal Data, is at your own risk.

If we suspect that there has been a security incident involving your Personal Data, we will notify you and any applicable regulator of a breach where we are legally required to do so.

Your Privacy Rights

You always have the right to opt-out of receiving our marketing or promotional communications. Depending on your geographic location, you may have certain additional privacy rights.

United States: If you are in the US, you may have rights under certain US state data protection laws. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law.

If you are a Delaware resident, you have the following rights under the Delaware Personal Data Privacy Act:

  • Right to confirm processing – you have the right to know whether we are processing your personal data;
  • Right to access – you have the right to access the personal data we have collected about you;
  • Right to correct – you may ask us to correct any inaccuracies in your personal data;
  • Right to request deletion of personal data – you may ask us to delete personal data that you provided to us or that we obtained about you from a third-party source;
  • Right to data portability – you may request a copy of your personal data that we collected about you in a readily usable format;
  • Right to Opt-out of the sale of your personal data, or using your personal data for targeted advertising or profiling in furtherance of solely automated decisions that has significant legal effects concerning you;
  • Right to Non-discrimination – as a business, we shall not use your personal data to unlawfully discriminate against you; and
  • Right to obtain a list of third parties to whom we disclosed your personal data.

If you are a Texas resident, the Texas' Data Privacy and Security Act provides you with the following consumer rights:

  • Right to Access – you may ask us to confirm whether we are processing your personal information and to access the personal information;
  • Right to Correct – you may ask us to correct any inaccuracies in your personal information;
  • Right to Delete – you may ask us to delete personal information that was provided by you or that we obtained about you;
  • Right to Data Portability – you may request a copy of your personal data in a readily usable format; and
  • Right to Opt-Out of Sale, Targeted Advertising, or Profiling in furtherance of a decision – you may opt-out of the processing of your personal information for sale, targeted advertising or profiling in furtherance of a decision that produces a legal or similar significant effect concerning you.

Exercising your rights

You may exercise your privacy rights twice in a calendar year. To do so, you may submit a verifiable request to us by either (1) emailing team@sellabella.com and use "Data Privacy Rights" in the subject line; or (2) sending us a written request to 436 Southbridge St #1017 Suite 2, Auburn, MA 01501 Attn: Data Privacy Rights or (3) calling 781-332-5438.

In order for us to act upon your request, we will need to verify your identity to a reasonable degree of certainty. We may therefore ask you to provide three points of Personal Data which you have previously provided to us that we can use to match against our records to verify your identity. We may also require you to submit a signed declaration under penalty of perjury stating you are the individual whose Personal Data is subject to the request. We may not be able to respond your request if you decline to provide the verifying details or if any of the details are incorrect.

In general and unless otherwise stated in the above sections describing your rights, we will respond to your request within forty-five (45) days. If necessary, we may extend the time to respond by a further forty-five (45) days. If for any reason we decide to decline to respond to your request, we will notify you and provide our explanation and any appeal process that may be available to you.

Children's Information

Our Site is not directed to or targeted towards those who are under 18 years of age. We do not intentionally allow users under the age of 18 to access our Site or use our Services, and we do not have actual knowledge that we have collected the Personal Data of anyone under the age of 16. If we learn that we a user under 16 has submitted Personal Data to us, or if we learn that the Personal Data is from one who is under 16, we will attempt to delete that Personal Data as soon as possible.

Privacy Policy Updates

We reserve the right to amend this Privacy Policy at our discretion and at any time. If we change the way we collect, use, or disclosure your Personal Data that require us to make changes to this Privacy Policy, we will post a notice on this page and update the Privacy Policy's effective date. Your continued use of our Site following any posted updates to the Privacy Policy constitutes your acceptance of such changes.
